§ 1 Scope

These Terms govern the contract between Florian Heuberger ("we") and the user ("you") for the use of Beet Lotse (Web, iOS, Android) and all paid tiers.

§ 2 Contract formation

The contract is formed when you confirm "Create account" / "Activate Pro" and we confirm by email. Pre-contractual information per Art. 246a EGBGB is shown on the respective pricing page and integrated here.

§ 3 Scope of service

  • Free tier: permanently free with the limits described on the pricing page.
  • Pro tier: extended functionality for a recurring fee.

We provide the service on a best-effort basis with a target monthly availability of 99 %. Maintenance windows and outages due to force majeure or third-party issues (hosting, push services, app stores) don't count against availability. No service-level guarantee is given for the Free tier.

§ 4 Fees and payment

Current prices live on the pricing page and are shown clearly before any paid signup. All prices include statutory VAT where applicable. Payment is processed by the providers shown at checkout (Stripe, Apple In-App Purchase, Google Play Billing); their terms apply to the payment leg.

§ 5 Term and termination

Free accounts exist until you delete them. Pro subscriptions auto-renew for periods of one month at a time and can be cancelled to the end of the current renewal period (§ 309 Nr. 9 BGB). No auto-renewal longer than one month is agreed. Cancellation is possible via the in-app "cancel contract" button (§ 312k BGB) or by email. The right to extraordinary termination for cause remains unaffected for both sides.

§ 6 Right of withdrawal

Consumers have a statutory right of withdrawal. See the Withdrawal information for the details and the sample withdrawal form.

§ 7 User obligations

  • Provide accurate information at sign-up and keep it current.
  • Keep your credentials private. On suspected misuse, change your password and notify us.
  • Don't upload content that infringes third-party rights or introduce malware.

§ 8 Liability

We are fully liable for damages from intent or gross negligence, injury to life, body or health, breach of a warranty, and under the German Product Liability Act. For slight negligence we are liable only for breach of a material contractual obligation ("Kardinalpflicht" — one whose fulfilment is essential for the proper performance of the contract and on which you regularly rely); in that case our liability is capped at typical foreseeable contract damages.

Further liability — in particular for lost profit, indirect damages, or data loss that proper backups on your side would have prevented — is excluded.

§ 9 Data protection

What personal data we process and on what basis is in our Privacy Policy. For commercial use where you act as controller of third-party data, we provide a Data Processing Agreement on request.

§ 10 Changes to these terms

We may amend these terms for legal or operational reasons with at least four weeks' notice via email. Silence constitutes acceptance; we'll point that out explicitly in the notice. If you object, the contract ends when the new terms take effect.

§ 11 Closing provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection in your country of habitual residence remains unaffected. Place of performance and exclusive venue (so far as legally permitted): Hammersbach. Should any provision be unenforceable, the others remain effective.
